L itigation ManagementIt is Creative Risk Controls philosophy that good litigation management can be achieved through adherence to some basic and well-defined procedures that are proactive, and not merely a delegation or an abandonment of our responsibility to defense counsel. Our basic purpose in establishing litigation management is to meet our obligations to our clients by actively controlling this most costly element of the claims process. It is important to try to avoid litigation up front. Proper evaluation of claims, making appropriate contacts early on and working with claimants, client and witnesses can help reduce the opportunity for litigation. If a lawsuit does occur, we work with attorneys with the appropriate background to develop a litigation management plan. Our claim adjusters evaluate each case to address settlement possibilities or prepare for litigation, and determine a budget for claims.
It is Creative Risk Controls responsibility to actively control the litigation process, and to utilize the most cost effective practices, procedures and strategies to provide a quality defense and protect the interest of our clients thus providing our clients with the most favorable result at a reasonable cost. |
